专业陪审员制度的性质与普通陪审员截然不同,对当事人处分权与辩论权的侵犯和职权主义倾向带来的诉讼结构偏斜与当今民事领域发展方向背道而驰。同时,其对鉴定制度的补充和代替实际上已经造成了对鉴定制度发展的阻碍。我们应该以构建鉴定制度为基础,以构建专业法庭、吸收专业人员为临时法官为过渡来开辟我国认定专门问题的制度进路。
