The Development of Local Legislation in Shanghai: Review and Experience

在过去的38年里,上海地方立法可以分为五个阶段,即20世纪80年代的立法初创期,20世纪90年代的立法高速发展期,21世纪前10年立法的规范发展期,国家法律体系形成后立法的转型发展期和党的十八大以来地方立法的变革创新期。上海每一时期的地方立法都具有鲜明的时代特征和上海特色,始终与改革开放相伴,与经济发展、社会转型同行,与国家民主法制的发展进程同步。

In the past 38 years, the entire local legislation in Shanghai can be divided into five stages, namely, the initial stage of local legislation in the 1980 s, the rapid development stage in the 1990 s, the normative development stage in the first decade of the 21 st century, the transitional development stage after the formation of the national legal system, and the reform and innovation stage since the 18 th Party Congress. The local legislations in Shanghai in each period have distinct characteristics. It has always been accompanied by reform and opening up as well as economic development and social transformation, and synchronized with the development process of the country’s democracy and legal system.
