摘要
依据著作权法将作品贡献给公共领域是相当困难的。CC0能够让权利人放弃全部著作权,为作品开辟新的传播渠道,作品能被更多人分享,为专有权和公共获取之间的利益平衡增加了筹码。文章用比较的方法分析了CC0与CC Licenses之间的异同,用CC0文本的具体条款和美国法院的判例说明CC0具有法律效力,认为CC0客观上对著作权法是一种补充。同时用实例说明欧美国家图书馆、博物馆等已经用CC0将部分馆藏投入到公共领域,最后,具体提出在利用CC0时需要注意的问题。
It’s quite difficult to dedicate the works to the public domain under the current copyright law. CC0 enables copyright and database right holders to waive all interests in their works, pens up a new communication channel for works so that it can be shared by more people, and adds chips to the balance of interests between exclusive rights and public access. The paper analyzes the similarities and differences between CC0 and CC Licenses with comparison method, meanwhile, illustrates that some libraries and museums of European and America have put some collection into the public domain by CC0. It is proved that CC0 contributes to the discovery and utilization of works, and CC0 works are easier to be searched.
