我国未成年人被害救助机制的合理构建

The Rational Construction of Chinese Juvenile Victims Relief System

近年来,曝光在公众视野的侵害未成年人合法权益的案件不断增多。如何保护未成年人的合法权益,构建未成年人被害救助机制成为了我国理论研究与实践探索的重心之一。合理构建我国未成年人被害救助机制,应当从广义的层面入手,将受刑事、民事、行政等不法行为侵害的未成年人纳入范畴,结合法学与社会学基础理论,构建被害补偿、司法援助、被害社会援助三层次并进的未成年人被害救助机制。当然,被害救助的另一层面要求加大被害预防。因此,应当从家庭预防、学校预防和司法预防入手,积极预防未成年人被害事件的发生。

Recently,cases of offending the juveniles which has been exposed to the public is increasing.How to construct an system of juvenile victims relief and how to protect the legal interests of juveniles are crucial to Chinese theoretical researches and Chinese judicial practice.This article is trying to adopt generalized sense and consider the juveniles who are victimized by criminal offends,civil and administrative illegal actors as victims.At the same time,we should combine jurisdictional and social theories and try to build a juvenile victim relief system with three levels that contains victims compensation,legal aid and social aid.Obviously,preventing being victims are significant to this system.Therefore,we should start from family to justice,and then prevent juveniles to be victims positively.
