Disputes About the Nature of PPP Project Contracts and Reflections on Administrative Law

PPP项目合同是PPP项目实施的基石,它既具有公法特征,也兼具私法特性,故学术界对其定性尚存在较大分歧,形成了"私法合同性质论""公法合同性质论""公私法性质兼有论"三种不同的观点。但"私法合同性质论""公私法性质兼有论"没有注意到PPP项目合同中必然存在的行政监管与行政监管权,也没有注意到PPP项目合同在合同目的、解除、纠纷解决等方面的特殊性,更没有注意到发展中的行政法与行政法学有能力承担起规制好PPP项目合同的重任。

PPP project contract is the cornerstone of PPP project implementation.It has both the characteristics of public law and private law.Therefore,there are still great differences in its nature in academic circles,forming three different viewpoints: the theory of the nature of private law contract,the theory of the nature of public law contract and the theory of the nature of both public and private law.However,the “theory of the nature of private contract” and “the theory of the nature of both public and private law” fail to notice:The power of administrative supervision and supervision inevitably exists in PPP project contracts,and the particularity of PPP project contracts in terms of contract purpose,rescission and dispute resolution.The developing administrative law and administrative law have the ability to shoulder the heavy responsibility of regulating PPP project contracts.
