司法民主视野下我国“陪审专业户”问题的解决路径

Solutions to the Problem of “Professional Jury” in the View of Judicial Democracy

人民陪审员制度能让普通公民协助司法、见证司法、参与司法,充分体现人民主体地位和司法民主功能,但在司法实践中长期存在"陪审专业户"问题,妨碍了民众的平等参与,违背了法定的程序要求,也不利于实现司法公正。为此,应利用信息化手段完善随机抽取的方式,细化随机抽取方式的法律规定,加强对随机抽取方式的监督,以有效解决"陪审专业户"问题,进一步促进司法民主。

The system of people’s assessors enables ordinary citizens to assist, witness and participate in the administration of justice, fully reflecting the people’s dominant position and the function of judicial democracy.However, in the judicial practice, there is a longstanding problem of professional jury,, hindering the equal participation of the public and violating the requirements of legal procedures, which is not conducive to the realization of judicial justice. Therefore, information technology should be utilized to improve the random selection method, refine the legal provisions of the random selection method, and strengthen the supervision of the random selection method, so as to effectively solve the problem of professional jury and further promote judicial democracy.
