摘要
基于对雇主劳动违法原因的不同假设,劳动监察干预政策可分为惩罚导向型和教育导向型两种类型。这两种劳动监察监管范式各具优缺点,但单纯依靠任何一种监管范式都不能很好地解决劳动监察执法困境问题。智利劳动监察管理体制采用了综合型集权管理体制,与其他拉丁美洲国家劳动监察普遍采用的教育导向型干预政策不同,智利劳动监察无论是监管理念选择还是劳动监察执法实践,都具有很强的惩罚导向的监管特点。近年来智利劳动监察干预政策开始从惩罚导向转向"惩教结合",以弥补惩罚导向型干预政策存在的政策缺陷问题。
Based on different assumptions of the reasons for employers'labor violation,labor inspection intervention policies can be divided into two types:punishment-oriented and education-oriented.These two paradigms of labor inspection have their own advantages and disadvantages,but it is not possible to solve the dilemma of labor law enforcement simply by relying on any one of them.The labor inspection in Chile adopts a comprehensive centralized management system.Different from the education-oriented intervention policies generally adopted by the labor inspection in other Latin American countries,the labor inspection in Chile has strong penalty-oriented characteristics in both supervision concepts and the practice of labor law enforcement.In recent years,Chile's labor inspection intervention policies began to shift from punishment-oriented to the combination of punishment and education,so as to make up for the policy defects in the punishment-oriented intervention policy.
