前海自贸区友好仲裁规则构建之进路:学理与三层式架构

Analysis on the Construction of the Amicable Arbitration Vithin Qianhai Free Trade zone: Theory and the Three-Layer-Construction

前海自由贸易区在研究并打造国际仲裁中心的过程中,应肯定并接纳友好仲裁作为其仲裁方式的一种。通过发掘前海自贸区友好仲裁规则构建的诸多契机,并结合构建这一规则的三种理论模式,得出"前海自由贸易区在构建这一规则时应采纳二元构建模式与多元构建模式相结合的方式"这一结论。在对诸多域外国家立法进行借鉴的基础上,友好仲裁规则在前海自由贸易区应该形成"立式"的三层架构:首先应肯定在未来即将出台的仲裁规则里植入友好仲裁规则,而后前海地区的司法部门可通过发布相关的指导意见与办法来丰富友好仲裁规则的内容,并通过加强研究相关的配套制度来保障友好仲裁规则的顺利实施。

Qianhai Free Trade Area should affirm the amicable arbitration as a general form of arbitration when constructing the international arbitration center. After researching the chance of forming the amicable arbitration and relevant theories, there will be an important conclusion that when constructing the international arbitration center,Qianhai Free Trade Area should adopt the Binary construction mode and the pluralistic construction mode. When fully learning the legislation from the other states, the amicable arbitration should be formed as a three-layer-construction on the basis of Qianhai Free Trade Area. When absorbing the amicable arbitration into the arb让ration regulation before promulgating the guidance from the judiciary for enriching the content of the amicable arbitration, the legislative department could research a legal system for protecting the implementation of the amicable arbitration.
