摘要
文中在审查国际国内关于海船最低安全配员的法律法规的基础上,指出目前海船最低安全配员证书核发中存在的问题:与国际做法存在差距,且未按《最低安全配员原则》要求制定工作指南。导致目前海事系统配员核发工作缺乏统一性,核发的最低安全配员证书不尽相同,给船东及现场执法人员造成困惑。建议修改我国船舶最低安全配员规则,制定工作指南,确保配员核发工作与国际接轨与国内现实情况相符合。
Based on a review of international and domestic laws and regulations on the minimum safe manning of sea-going vessels,the paper identifies the problems existing in the issuance of the minimum safe manning certificates for sea-going vessels,i.e. the gap with international practice and the lack of work guidelines in accordance with the Minimum Safe Manning Principles. The above problems have led to the inconsistency in the issuance of manning certificates and the difference between minimum safe manning certificates issued,causing confusion for shipowners and on-site law enforcement personnel. It is suggested to amend the rules on minimum safe manning for ships in China and formulate work guidelines,in order to ensure that the manning issuance of China is in line with international practice and in conformity with domestic circumstances.
