Rules and Methods:PPP Project Risk and Its Three-level Regulatory Theory

PPP模式在项目运行的不同阶段存在不同的风险,影响项目正常运行。PPP项目风险可以划分为决策阶段之风险、执行阶段之风险、评估救济阶段之风险、跨PPP项目生命周期各环节之风险。我国已经基本建立了多层次的监管体制,但仍存在法律规范不健全、多头监管、政策监管权缺乏约束等问题。对PPP项目风险进行规制,其核心就是构建PPP项目风险三阶规制体系,建立事前预防、事中治理、事后救济的基本框架,根据项目实施不同阶段采取风险预防措施、风险控制措施和权利救济措施。

In recent years,the "Public Private Partnership"(PPP) has been surging in China,and it has effectively promoted the development of public utilities in China.However, the PPP mode is not perfect.There are different risks in different stages of the PPP project,affecting the normal operation of the project.By examining the existing administrative supervision system of PPP risk in China,it is find that there are many problems,including imperfect legal norms,long supervision and lack of restrictions on government regulatory power.Therefore,on the basis of perfecting the legislation of PPP mode,we should apply various means of regulation,constructing the three-level regulatory system of project risk in advance prevention,in case management and after relief to ensure the smooth operation of PPP project.
