摘要
"开发权转移"是牵涉土地产权与空间管制的制度设计,具有以市场的方式完成空间资源优化配置并实现保障个人财产权利的制度优势。本文以东莞水乡特色经济发展区为例,通过对比研究和问题分析,认为"国内外制度环境差异"对"开发权转移"制度的地方化过程并不构成重要障碍,但在"权利主体意愿、开发权市场供需关系、与既有政策关系、空间管制"等问题的影响下,采用"开发权转移"来帮助东莞水乡实现减量目标还存在一定的适用困境。
Transfer of Development Rights(TDR)is an institutional design concerning land property rights and space management,which is advantageous in realizing the optimization of spatial resources allocation and protecting private property rights through market means.Based on a case study of featured economic development zone in Dongguan Water Town,this paper points out that"difference in institutional environment at home and abroad" does not form major obstacle to the localization process of TDR through comparative research and problem analysis.However,there are still certain applicability difficulties in using TDR to help achieving the goal of decrement development in Dongguan Water Town under the impact of problems such as "willingness of stakeholders,supply and demand relation of development rights on market,relationship with existing policies,and space management."
