总体国家安全观下的反恐国际合作――以《反恐怖主义法》为例

International Cooperation against Terrorism under the Overall National Security Concept――Taking the Anti-Terrorism Law as an Example

我国积极开展反恐国际合作,既是坚持总体国家安全观,维护国家安全稳定的需要,也是应对国际恐怖活动犯罪的要求。我国反恐国际合作应在总体国家安全观的指导下进行,立法工作应保持前瞻性、预防性和内外协调性。《反恐怖主义法》对我国开展反恐国际合作的法律依据、主体以及内容均予以规定,反恐国际合作的推进应据此进行。此外,还应做到坚持联合国的主体地位,进一步完善反恐合作法律框架,以沟通促合作,积极寻求反恐国际合作条约和刑事司法合作条约的达成。

China's active international cooperation in counter-terrorism is not only the need to uphold the overall national security concept,but also to safeguard national security and stability.It is also a requirement for responding to international terrorist activities.China's counter-terrorism international cooperation should be conducted under the guidance of the overall national security concept and the legislative work should be forward-looking,preventive and with internal and external coordination.The Anti-Terrorism Law stipulates the legal basis,subject and content of China's international cooperation against terrorism and the promotion of international cooperation against terrorism should be carried out accordingly.In addition,we should also adhere to the main position of the United Nations,further improve the legal framework for counter-terrorism cooperation,promote cooperation by communication and actively seek the conclusion of the international cooperation treaty on counter-terrorism and the criminal justice cooperation treaty.
