全国人民代表大会于2019年3月15日表决通过了《中华人民共和国外商投资法》。作为专门的外资法典,该法重构了我国的外资基础性法律。《中华人民共和国外商投资法》将专注于政府对外商投资的促进和保护,对外商投资、外国投资者和外商投资企业的管理。本文拟结合该法的立法进程,对《中华人民共和国外商投资法》的若干重大问题做一探析,以此阐明该法在中国投资自由化和便利化中的影响。

The Foreign Investment Law of the People's Republic of China was adopted by the National People's Congress on March 15 , 2019. As a unified code governing foreign investment, the law will constitute the basic law for foreign investment in China. The Foreign Investment Law of the People's Republic of China focuses on the promotion and protection of foreign investment, the management of foreign investment, foreign investors and foreign-invested enterprises. The paper outlines the history of the legislative process, and highlights the most important issues of the Foreign Investment Law of the People's Republic of China with a view to shedding light on the implications of this law for investment liberalization and facilitation in China.
