The New Empire Under the Curtain of The Exception——Rereading Empire: The Political Order of Globalization

哈特、奈格里所著的《帝国:全球化的政治秩序》一书论证了新帝国秩序的生成逻辑,其中有三个不可回避的关节点:一是当代国际法秩序的理性奠定者汉斯·凯尔森,通过理性解构民族国家的主权理论,在主权国家之上建立一个超越各民族国家的国际法秩序,从而形成各个主权国家组成的、具有大同性质的跨国政治有机体;二是由中世纪开始出现的正义战争理论,通过奥古斯丁、阿奎那经院神学家到格劳修斯等新教神学家",正义战争"的概念经过几次嬗变,最终通过几次大型战争创造出符合新国际法秩序的唯一正义;三是借助西方马克思主义者本雅明、福柯、阿甘本等预言(证实)的例外状态常规化治理手段,通过"警察权"充当"例外之幕"遮蔽全球规训之实质,对普世秩序进行干涉的强制。

Empire: The Political Order of Globalization by Hardt and Negri demonstrates the new generation logic of imperial order, in which there are three inevitable key points. First, Hans who is considered as the founder of the rationality for the contemporary international law order, based on rational deconstruction of na?tional sovereignty theory, has established an international law order beyond nations on sovereign nations, thus forming international political organism composed of various sovereign states, with characteristics of Great Harmony. Second, the theory of just war emerged from the middle ages. From the scholastic theologians such as Augustinus and Aquinas to Grotius and others protestant theologians, the concept of"just war"went through several changes and finally established the only justice in line with the new international law order through several large-scale wars. Third, by means of the regularization of the exception state governance pre?dicted(or confirmed) by Benjamin, Foucault, Agamben and other the western Marxists, through the"police power"as the"screen of the exception"to cover the essence of global discipline, the universal order is being intervened in the coercive.
