高校学术领域性骚扰防治体系的功能定位及其建构

Functions and Construction of Academic Sexual Harassment Prevention System of the Universities

高校学术领域性骚扰具有性骚扰的一般属性,同时又在行为性质、当事双方的关系、侵害的客体以及行为后果等方面具有异于其他性骚扰的特殊属性。其防治体系的建构应同时兼具指向所有性骚扰的一般性防治功能,以及仅指向学术领域性骚扰的特殊性防治功能。两种功能应内化在高校外部和内部两个规范体系之中,分别为旨在实现一般性防治功能,以私权保护为中心、以国家层面的综合性法律为载体的防治体系,以及旨在实现特殊性防治功能,以行为预防为本、以高校内部的自治性规范为载体的防治体系。

Academic sexual harassment of the universities features general attributes of sexual harassment, as well as special one differing from other types of sexual harassment in the aspects of behavioral nature, relationship of parties, objects of infringement, consequences of behavior and etc. The construction of prevention system shall take both the general function of all sexual harassment prevention system and special prevention function of academic sexual harassment of the universities into account. The two functions shall be incorporated into the external and internal regulating system of the universities, which refers to the private rights protection-centered general prevention system based on national comprehensive laws, and behavioral prevention-based special system based on autonomous regulations within the universities.
