乡村治理视角下村规民约的变与常——以贵州省锦屏县平秋镇魁胆村为考察对象

The Changes and Ordinaries of Village Rules and Conventions from the Perspective of Rural Governance——An Investigation on Quedan Village, in Pingqiu Town, Jinping County of the Guizhou Province

村规民约在乡村治理中具有积极作用。考察贵州省锦屏县平秋镇魁胆村1992年到2014年的村规民约,可以发现其在数量、名称、结构、目的、规范、后果、责任、处理、数额等方面发生变化,呈现出与时俱进的发展态势。同时,村规民约在议定程序、基本立场、主要内容、传承传统、体现地方特点、执行组织、收费调解等方面总体如常。就整体而言,村规民约维系自治、维持乡村治理,没有离开办理公共事务、建设公益设施、维护社会治安、解决民间纠纷、保障村民权益之中心目标。村规民约变化的内容为表面性的部分,而实质性内容没有发生变化,作为村民自治、乡村治理的保障工具没有变化。

Village rules and customs conduct an active role in rural governance.After investigating these regulations and rules practised in Kuidan Village from 1992 to 2014,the author revealed the changes of rules in quantity,name,structure,purpose,standard,result,duty,treatment and amount,which presented a trend of advancing with the times.Meanwhile,the regulations and conventions proceeded as usual in negotiation procedure,position,main contents,traditional inheritance,local feature,implement organ and fee mediation,etc.On the whole,the village rules and regulations maintain autonomy and rural governance,and adhere to the central objectives of public affairs,public welfare facilities,social security,settlement of civil disputes and protection of villagers'rights and interests.The changed contents of village rules are superficial,and the substantive content has neither changed nor converted as the tool of villagers'autonomy and village governance.
