General principles of law as a source of international law

一般法律原则从提出之日起,其国际法渊源地位就受到许多公法学者的质疑。有学者认为其与国际法基本原则无异,也有认为其在国际司法实践中并不重要。但是,一般法律原则作为国际法的渊源也得到了许多权威国际公法学者的支持,并通过《国际法院规约》第38条加以明确规定,而且还有丰富国际法实践加以佐证,其地位毋庸置疑。

General principle of law was once questioned as a source of international law,because of the confusion between general principle of law, fundamental principles of international law and customary international law. Some scholars think general principles of law can′t play an important role in international judicial practice. However, the Statute of the International Court of Justice and a large number of international courts′ practices show that general principle of law can be used as a direct source of law and become the legal basis for the courts′ judgment. It is undeniable that general principle of law is a source of international law.
