文化艺术政策与文化法的同一性及差异性

在当代社会,文化艺术的政策与文化法既具有同一性又具有差异性,其同一性主要表现在对人民负责和对文化艺术建设负责的一致、致力于推进文化艺术建设的健康发展,以及努力保障文化与艺术的安全等方面。其差异性主要表现在,政策具有战略性,法律法规具有现实性;政策具有一定的灵活性,法律法规具有稳定性;政策具有抽象性,法律法规具有具体性;政策具有引领性,法律法规具有强制性。把握二者的差异,可以充分发挥其各自优势,化解矛盾与歧义,实现求同存异。政策与法律法规存在于一个统一体中,它们是共存的、联动的,也是可以相互转化的。

In contemporary society , Cultural and Artistic Policy and Cultural Law both have Identity and differences. The identity is mainly reflected in taking responsibility for the people and the construction of culture and art, promoting the healthy development of the construction of culture and art, and guaranteeing the security of culture and art. The differences mainly involve : the Policy is strategic , flexible , abstract and guiding, while the Law is realistic , stable ,concrete and mandatory. By understanding the differences between them , we can take full advantage of each of them , resolve contradictions and ambiguities, and seek common ground while reserving differences. The Policy and the Law are the unity of opposites;they can achieve co - existence , co - movement and mutual transformation.
