The Theoretical Basis and Legal Approach to the Division of Government Power

政府事权划分包括横向划分与纵向划分两个维度。政府事权划分对于明确政府职责定位、提高政府行政效率、提升政府公共产品质量以及促进政府间权力的分工、合作与平衡具有重要价值与意义。建国以来,我国政府事权划分的法治化取得了重大进步,但也存在着一些影响因素。对此,应进一步理顺政府与市场的关系、明确政府职责、完善事权划分的法律制度、明确政府事权划分的基本原则、健全政府事权纠纷处理机制,推进我国政府事权划分的法治化进程。

The division of government power includes two dimensions: horizontal division and vertical division.The division of government power is helpful to position clearly the government responsibilities, improve the government administrative efficiency, promote the quality of public goods, and realize the checks and balances of power. Since the founding of the People’s Republic of China, the legalization of the division of government power has made great progress, but there are also some influential factors. In this regard, we should further clarify the relationship between the government and the market, clarify the responsibilities of the government, improve the relevant legal norms of the division of power, clarify the basic principles of the division of government power, improve the mechanism for the coordination of the disputes between the government and the government, and promote the legal process of the division of government power.
