中国体育法学:“场域”调适、规范集成与方法自觉

Chinese Sports Law:Adjustment of Field,Integration of Standards and Consciousness of Method

作为"借壳"于体育的法学边缘学科,体育法学跨越于体育学和法学之间,这也直接导致了学界对中国体育法学学科属性的争议。从时间脉络上而言,自体育法学这门学科创设之日起,即面临着内生理论建构的先天不足和外在制度实践的实施困局。因此,对于尚处于学科培育期的中国体育法学而言,话语体系的自给自足尤为关键,这也将同时决定着中国体育法学的学科理论能否得以自我证成。放眼未来,"场域"重构、规范集成与方法自觉构成了影响中国体育法学发展的三重要素,这三重因素也同时构成了中国体育法学研究的新型知识增长点。在未来的研究进程中,这3种问题理应得到中国体育法学学人的理论关怀与精准回应。"场域"重构,即是对中国体育法学研究维度的界定,它所要凸显的是中国体育法学研究中的问题意识;规范集成,即是对中国体育法学学科特性的逻辑解构,它试图明晰的是中国体育法学的"领域法"属性;方法自觉,即是对中国体育法学研究方法的再次审视,它试图对中国体育法学的未来演进方向进行方法论布局。未来语境中,中国体育法学学人唯有对以上三重问题进行追寻与探索,方能实现中国体育法学的理论革新与制度优化。

As a "law discipline backdoor" in sports,sports law across between sports and law,which led directly to the scholars to dispute the China sports law subject property. In terms of time,since the founding of the discipline of sport law,we faced with the congenital shortage of endogenous theory construction and the dilemma of external system practice. The self-sufficiency of the discourse system is particularly crucial for the Chinese sports law,which is still in the period of discipline cultivation. Looking to the future,the reconstruction of "field",the integration of norms and methods constitute three important factors affecting the development of sports law in China. Therefore,these three questions deserve the theoretical concern and precise response of Chinese sports law scholars.The reconstruction of "field" is the definition of the research dimension of sports law in China,which should highlight the problem consciousness in the study of sports law in China. Standard integration is the logical deconstruction of the discipline characteristics of sports law in China,which should clarify the "domain law" attribute of Chinese sports law. Meanwhile,methodological consciousness is a re-examination of the research methods of sports law in China. It attempts to make a methodological layout of the future evolution direction of sports law in China. In the context of the future,only by pursuing and exploring the above three issues can Chinese sports law scholars achieve theoretical innovation and system optimization.
