分享经济下“无证经营”的法律分析——以私人厨房为例

Legal Analysis of "Unlicensed Business" under the Sharing Economy—— Taking private kitchen as an example

随着互联网技术的发展,“分享经济”这一概念渐渐进入人们视野。“分享经济”的领域也从交通、住宿等传统领域而向餐饮、物流、教育、医疗等延伸。而作为一种新型的经济业态,“分享经济”必不可免地会对传统的政府治理手段造成冲击,尤其是我国政府一直依赖的行政许可制度。面对“分享经济”,应当针对其本身特征,而不能僵硬地将行政许可制度照搬适用,以防抑制创新。应当积极利用平台监管措施以弥合当前的管理空白。

With the development of Internet technology,the concept of"sharing the economy"has gradually entered the field of vision.The field of"sharing economy"also extends from catering,logistics,education and medical treatment to traditional areas such as transportation and accommodation.As a new type of economic industry,"sharing the economy"will inevitably impact on the traditional means of government governance,especially the administrative licensing system that our government has always relied on.In the face of"sharing economy",we should aim at its own characteristics,and can not rigidly copy and apply the administrative licensing system to prevent innovation.We should actively use platform supervision measures to bridge the current management gap.
