上海市地方性法规行政处罚罚款数额和幅度研究

On Amount and Range of Administrative Penalty in Local Regulations of Shanghai

行政处罚作为行政机关履行其监督管理职能的一种手段,对健全市场制度、建设民主法治社会起着重要的推进作用。但在行政执法实践中,行政罚款被普遍、频繁、密集地使用,是亟待规范的重点和难点。目前,含有行政罚款的上海市地方性法规有97部,罚款构成数为634项。本文将各具体指标分为样本基本属性参数、罚款设定方式参数、罚款设定比较参数三大类,辅之以21个行政执法部门的222份调查问卷,对上海市地方性法规罚款设定的合理性、科学性和协调性予以全面审视,深入、系统地梳理罚款设定种类及其组合方式,廓清了上海市地方性法规罚款设定的基本状况和存在的问题,进而得出完善上海市地方性法规行政罚款设定的对策建议。

Administrative penalty, a means of administrative organs to excise their power of supervision and administration, plays an important role in promoting the perfection of market system and the building of domestic society ruled by law. However, it is an urgency to regulate administrative penalty due to its wide, frequent and intensive use in the practice of administrative law enforcement. Based on the collection and analysis of 97 local regulations of Shanghai, including 634 illegal acts subject to administrative penalty, and 222 questionnaires from 21 administrative law enforcement departments, and with indicators divided into three parameter types: samples' basic attributes, ways of administrative penalty setting and comparisons between administrative penalty setting, this paper provides some advice on the perfection of penalty clauses in local regulations of Shanghai after conducting a comprehensive review of the seasonality , scientificity and coherence of penalty clauses in local regulations of Shanghai, a detailed classification of administrative penalty and a clarification of the status quo and existing problems of penalty clauses in local regulations of Shanghai.
