网约车平台与传统平台相比,网约车平台与驾驶员、乘客之间法律关系更加紧密,应当承担更多的责任。网约车平台公司与驾驶员之间、平台公司与乘客之间存在法律关系,网约车平台公司在各类型交通事故中应当承担法律责任。受害人为乘客时,平台公司承担违约责任或者侵权责任。受害人为第三人时,若责任在网约私家车一方,平台公司应承担侵权赔偿责任;若责任在乘客一方,平台公司应承担相应赔偿责任。当受害人为驾驶员时,平台公司应承担工伤赔偿或按照过错程度承担相应赔偿。
