摘要
目前,我国已逐步形成以宪法为根本依据,以劳动法为基础,以劳动合同法、就业促进法为主体,其他单项法律和行政法规为重要组成部分的劳动就业法律体系。但客观而言,如何保障劳动者的就业和择业仍是一个值得探究的问题,在促进就业中必须在法律层面进一步规制好国家、用人单位、劳动者之间的有机统一。
At present,China has gradually formed a labor employment legal system based on the Constitution and the Labor Law,with the Labor Contract Law and the Employment Promotion Law as the main body,and other individual laws and administrative regulations as an important part. But objectively,how to protect the employment and career choice of workers is still a question worth exploring. In the course of promoting employment,we must further regulate the organic unity among the state,employers and laborers at the legal level.
