新形势下道路交通事故检验鉴定存在的问题与对策研究

Research on Problems and Countermeasures of Road Traffic Accident Inspection and Identification under the New Situation

目前全国专业从事道路交通事故检验鉴定的公安鉴定机构较少,公安交管部门需开展此类检验鉴定时,大多委托社会或公安刑侦方面的鉴定机构进行。但目前道路交通事故检验鉴定在资质、管理、技术以及实践中均存在问题,影响了司法鉴定的科学性、公正性。本文通过对现阶段交通事故类司法鉴定工作的分析、研究,针对目前此类司法鉴定中存在的问题,提出理顺关系、统一管理,建设队伍、加强监督,深入探讨、完善和细化检验鉴定规范等相应对策,使道路交通事故司法鉴定更为科学、公正、规范。

At present, there are few public security appraisal institutions specializing in the inspection and appraisal of road traffic accidents in the country. When the public security traffic control department needs to carry out such inspection and appraisal, most of them entrust the appraisal agencies of social or public security criminal investigation. However, the current road traffic accident inspection and identification has problems in qualification, management, technology and practice, which affects the scientific and fairness of judicial identification. Through the analysis and research on the current judicial identification of traffic accidents, this paper finds out the problems existing in such judicial appraisal, proposes rational relations, unified management, builds teams, strengthens supervision, and deeply explores, perfects and refines inspection and appraisal. Corresponding countermeasures such as regulations make the judicial identification of road traffic accidents more scientific, fair and standardized.
