监管深化背景下互联网金融犯罪的侦防研究——以P2P网贷业态为例

Research on the Investigation and Prevention of Internet Financial Crime under the Background of Deepening Regulation

P2P网贷领域监管政策主要是"一个办法三个指引"。从平台运营时间、涉案金额、投资人数、侦查判决时间和返还率以及定罪量刑等多个角度,对P2P网贷业态领城的犯罪情况及法律风险进行分析。互联网金融犯罪的侦防应充分利用各种资金查控手段,依法查封、扣押、冻结涉案资金;建立跨区城、跨警种的合成作战机制和多部门联动协作的预警机制;加快信息化建设,加强数据化实战,促进类罪模型的研发。

The main supervision policy in the field of online P2 P lending is "one means and three guidelines". This paper analyses the crime situation and legal risk of the online P2 P lending format from several aspects,such as the runtime of the platform, the amount of fund and the number of investors involved, the lasting time of investigation and judgment, the rate of return,the conviction and sentencing. It is believed that the investigation and prevention of Internet financial crime should make full use of various means of fund investigation and control to seal up,distrain or freeze the funds involved in the cases according to law,a collaborative operational mechanism of cross-regional and cross-police should be set up and an early warning mechanism of cross-department linkage and cooperation should be established,the construction of informatizating and data-based combat should be sped up to promote the research and development of crime-model.
