以审判为中心背景下侦查取证若干问题探析

以审判为中心是我国正式确立的重要刑事司法制度,本文在长期调研的基础上,结合有关案例,对司法实践中侦查取证存在的若干问题进行探讨和剖析,并结合以审判为中心的刑事司法制度,提出了以审判为中心背景下侦查机关完善侦查取证的方法与措施。

The trial-centered system is an important litigation system established during Chinese criminal judicial reform. On the basis of long-term investigation and research, this paper discusses and analyzes problems of investigation and evidence collection in judicial practice with case studies. By combining them with the recently established trialcentered criminal judicial system, this paper proposes countermeasures of how investigative organs could improve their investigation and evidence collection skills under the background of trial-centered.
