A Research on the Legal System of the Law of War

在战争法、武装冲突法、国际人道法三个法律概念中,战争法起到了"统领"作用,国家战争权废除之前的传统意义上的战争与废除之后的武装冲突实质上都属于战争法的规制范畴。现代战争即武装冲突。国际人道法、武装冲突法是战争法在面对复杂形势下发展的分支,国际人道法、武装冲突法以及战争法的特有规制部分共同构成了战争法体系。同时清晰准确的战争法定义在理论层面对于战争法体系的发展完善以及战争实践中国家适用战争法规具有重要的指导作用。

The Law of War plays a leading role in the three legal concepts:Law of War, Law of Armed Conflict and International Humanitarian Law. The traditional War before the abolition of national right to war and armed conflict after the abolition are essentially the scope of the Law of War. Actually, modern warfare is armed conflict. Law of Armed Conflict and International Humanitarian Law are the branches of the Law of War that developed facing of complex situations. The Armed Conflict Law and International Humanitarian Law and the special regulation part of the Law of War law constitute the system of the Law of War. At the same time, a clear and accurate definition of the Law of War plays an important role in guiding the development and improvement of the system of Law of War and the application in practice.
