摘要
关于“漫画作品”著作权侵权问题,司法实践中更多地倾向以文字作品的思路进行著作权保护,以漫画寓意作为判断侵权的关键因素。根据文义解释与目的解释,“漫画作品”分别属于美术作品与文字作品,而美术作品与文字作品在著作权保护思路上存在较大差异,美术作品著作权的保护实质上在于保护艺术创作过程的结果,而文字作品著作权的保护实质上在于其文字作品的内容。若按文义解释,将“漫画作品”以美术作品的思路进行著作权保护,实质上降低了侵权人的违法成本,不利于“漫画作品”的著作权保护。故“漫画作品”作为绘画要素和语言要素有机结合的作品,在著作权保护的思路上应该更倾向于以文字作品的思路进行著作权保护。
Regarding the issue of copyright infringement of “comic works”,more tendencies in judicial practice are to protect copyrights with the ideas of written works,and the meaning of comics is the key factor for judging infringement.According to the interpretation of the meaning of the text and the interpretation of the purpose,“cartographs” belong to art works and literary works,respectively,while art works and literary works have great differences in the protection of copyright.The protection of the copyright of art works is essentially the result of protecting the process of artistic creation.The protection of the copyright of written works lies in the content of its works.If the textual interpretation is made,the “comic works” will be copyrighted by the idea of art works,which substantially reduces the illegal cost of the infringer and is not conducive to the copyright protection of “comic works”.Therefore,“Comic work” is a combination of painting elements and linguistic elements.In the idea of copyright protection,it is more inclined to protect the copyright with the idea of written works.
