政府和社会资本合作(PPP)项目具有投资大、周期长的特点,很多社会资本采用联合体投标的方式参与竞争。联合体参与PPP项目法律问题比较多,本文主要分析了联合体投标法律依据、联合体主体属性、联合体在SPV持股、联合体成员责任等问题。

PPP projects,as the cooperation between the government and the social capital,are characterized by huge investment and long cycle.A lot of social capitals participate in competition by means of joint bidding.There are a lot of legal issues involved in consortium participating in PPP projects.This article mainly analyzes the items such as the legal references of joint bidding,the attribute of consortiums as the main body,the SPVholding of consortiums,and the responsibilities of members of consortiums,etc..
