摘要
在"买卖不破租赁"规则的影响下,法院在通过司法拍卖程序执行涉及处理不动产的过程中,如果遇到存在租赁关系往往以"买卖不破租赁"为由不进行去除租赁权的拍卖,这严重影响了债权人的债权实现。司法执行中要综合司法拍卖中复杂的利益关系之间进行平衡,对拍卖标的根据物权属性区分,对住宅性不动产、非住宅性不动产和动产拍卖前采取不同方式处理租赁权,以保护承租人的合法利益,为司法拍卖击破租赁提供解决路径。
Under the influence of the rules of “buying and selling can not break lease”,the court in judicial auction program execution involved in the process of real estate,if there is a lease relationship often citing “buying and selling can not break lease” do not remove the lease sale,makes the bidder can't achieve earnings auction in a certain period,which seriously influence the extent of the obliges’ right to achieve. It must keep a balance between the interests of the complex relationship of judicial auction in judicial execution. According to the real right attribute,and before the auction of nonresidential real property and personal property of residential real estate,we should take different approaches to protect the legitimate interests of the lessee,and provide theoretical basis for the judicial auction to break the lease.
