摘要 文章探讨了城乡规划中土地发展权的作用机制,指出土地发展权是规划刚性管控的法律依据,土地发展权配置是规划刚性控制的支撑政策。同时,结合我国的土地制度,阐述了我国土地发展权的特征和流转机制,指出公共性和商品性是我国土地发展权的主要特征,政府主导是我国土地发展权流转的主要机制。在此基础上,尝试建立实现我国城乡土地发展权公平配置的规划策略与方法,提出将土地增值收益转移支付作为发展权公平配置的途径,将规划指标核算作为发展权公平配置的依据。 This article discusses the mechanism of land development rights in urban and rural planning,pointing out that land development rights are the legal basis for planning rigid management and control,and the allocation of land rights is the supportive for planning control.The article analyzes the characteristics and circulation mechanism of China's land development rights combined with China's land system.Publicity and commodity are the main characteristics of China's land development rights,and government leadership is the main mechanism for the transfer of land development rights in China.On this basis,the article attempts to establish the planning methods to realize the fair allocation of urban-rural land development rights in China.It proposes that the transfer of land added-value income as a means of fair allocation of development rights,and the accounting of planning indicators as the basis for the fair allocation of development rights.
