网络服务提供者“应知规则”的再厘定及适用探讨 被引量:9

摘要 现行法内容的抽象性和模糊性,导致了"应知规则"在我国网络服务提供者帮助侵权责任领域长期存有较大争议。理论界在"应知规则"与网络服务提供者在先审查义务和主观过错形态的关系认定方面存在固有认识误区。"应知规则"实质上是对网络服务提供者帮助侵权责任中"知道要件"的客观化认定,其规则标准是对具体、可识别侵权行为的认识。而对于网络服务提供者"应知规则"的具体适用,可以通过网络服务属性、侵权信息特征以及第三人通知这三个视角来加以分析判定。 The abstraction and obfuscation of the content of law leads to the controversy of “should-know rules” in the area of contributory infringement of China’s internet service providers. Theorists have inherent misunderstandings in the relationship between the “should-know rules” and the “duty to find the infringement” and the relationship between “should-know rules” and “subjective faults”. The “should-know rule” is virtually the objective identification of the “knowledge element” in the internet service provider contributory infringement. The deciding standard of the rule relies on the identification of the “specific and identifiable infringement”. For the specific application of the “should-know rules” of internet service providers, it can be analyzed and judged from the perspectives of “internet service attribute”,“infringement information feature”, and “third party notification”.
