校园欺凌的法律治理研究

On the Legal Governance of Campus Bullying

校园欺凌是国内外普遍存在的现象,它影响未成年人的健康成长,给未成年人的生理和心理造成巨大的伤害和影响。由于我国当前并未有专门针对校园欺凌的法律,只有根据校园欺凌的相关类型而涉及的权益保护条款零散地分布于一些法律中;加之对未成年人责任年龄的限制,导致大部分校园欺凌行为得不到相应的惩处,受害者得不到应有的法律保护。本文从理论与实践相结合的角度,探讨我国校园欺凌当前立法和司法的现状,发现现实困境与问题,进而建议我国出台校园欺凌专门立法,并提出相应的法律治理对策。

Campus bullying is a common phenomenon both at home and abroad, which affects the healthy growth of minors and causes great harm and influence to the physiology and psychology of minors. There is no specific law on campus bullying in China and only the rights and interests protection clauses involved in the relevant types of campus bullying are scattered in some laws. In addition, due to the limitation of the responsible age of minors, most campus bullying behaviors can’t be punished accordingly and the victims can’t get the legal protection they deserve. From the perspective of combining theory with practice, this paper explores the status quo of legislation and judicature of campus bullying in China, finds out the practical difficulties and problems and puts forward specific countermeasures and suggestions for the introduction of campus bullying legislation and legal governance in China.
