摘要
网络社会的发展催生了网络游戏产业,而围绕着网络游戏所产生的不同主体权益的保护,引发了关于网络游戏定性之争论。客观地分析,网络游戏作为一个承载了开发设计者智力劳动成果之集合体,从不同的视角可分别对开发者、代理商、网络游戏赛事组织者、游戏玩家的权益加以分析,并依据不同的制度予以相应之保护。对于跨界性问题,可通过反不正当竞争法对相关权益实施扩展性的保护。
The development of network society has spawned the industry of online games and the protection of the rights and interests of different subjects generated by online games has caused controversies about the qualitative nature of online games. From an objective perspective,online games can be regarded as a collection of intellectual labor achievements of development designers. This paper analyzes the rights and interests of the developers, agents, online game organizers and gamers from different perspectives and holds that the corresponding protection shall be given to the different subjects according to different systems. For the cross-boundary issues, the related rights and interests can be protected by laws against unfair competition.
