“一带一路”国家间金融监管合作法律问题研究

Research on Legal Issues of the Financial Supervision Cooperation Between the “Belt and Road” Countries

随着"一带一路"倡议的不断推进以及区域内国家金融合作的不断深入,金融监管合作问题日益凸显,具体表现为双边金融监管合作协议形式约束性不强、执行力较弱、多边金融监管合作协议缺乏系统性、金融监管合作协议覆盖层面较低、缺乏统一的金融监管合作标准和金融监管跨国协调机构、金融信息透明度较低。通过对"一带一路"国家间金融监管合作法律问题进行系统分析,以此归纳出解决"一带一路"建设中国家金融监管合作法律问题的建议:即以良法之治为理念制定"一带一路"多边金融监管合作规则,辅以大国引导,不断推动"一带一路"多边金融监管规则的落实。

As the "Belt and Road" Initiative has been undertaken and the financial cooperation between the "Belt and Road" countries has been promoted, the issues of financial supervision cooperation are becoming more and more prominent. Specifically, bilateral financial supervision cooperation agreements lack binding force and enforcement force, multilateral financial supervision cooperation agreements lack systematicness, and the coverage of financial supervision cooperation agreements are of low level. Besides, there are no unified financial supervision cooperation standards and multinational coordination agencies, and financial information is not transparent. Analyzing the financial supervision cooperation mechanism for the "Belt and Road" countries systematically, the article raises some proposals to solve the legal issues of the financial supervision cooperation for the "Belt and Road" countries. Formulating the multilateral financial supervision cooperation rules should be based on the concept of good law governance;in addition, assisted by the guidance of major countries, the implementation of multilateral financial regulations and rules have been achieved.
