本文从《我不是药神》引入对专利强制许可制度的思考,针对药品专利法条中著名的Bolar抗辩进行了分析,通过Bolar抗辩背后支撑的一套基于利益平衡精密考虑的系统来讨论专利强制许可制度可能有效的平衡机制。

This paper introduces the thinking of compulsory patent licensing system from I'm not the God of medicine , analyzes the famous Bolar defense in the pharmaceutical patent law, and discusses the possible effective balance mechanism of compulsory patent licensing system through a set of precise consideration system based on the balance of interests supported by Bolar defense.
