海外建厂是存在知识产权风险的主要环节,目前我国企业在该环节上的知识产权管理制度和手段还不够完善,有待进一步改进和加强。企业可以从确定建厂地点、选择管理模式和实施有效管理等方面对知识产权风险进行梳理,并进行有效地管控、防范和应对,以避免知识产权风险的发生或降低知识产权风险可能造成的影响。同时,根据海外当地的法律法规,对现有的机制和流程进行适应性调整,对研发中形成的知识产权成果进行及时保护,避免知识产权成果的遗失。

The establishment of overseas factories is the main link which is at the risk of intellectual property. At present, the intellectual property management institution and means of Chinese companies in the link are still not perfect and need to be further improved. Companies can sort the intellectual property risks from the choosing the location of the plant, selecting the management mode and implementing effective management. Then control, prevention and response should be implemented effectively in order to avoid or reduce the risk of intellectual property. As well as, modifying the current mechanisms and processes on the basis of the local laws and regulations, protecting own intellectual property during the R&D phase from losing in time.
