司法体制改革背景下主办侦查员制度构建与完善——基于S省D县主办侦查员制度运行情况的调研

Construction and Perfection of Chief Investigator System under the Background of Judicial System Reform: Taking the Survey in D County of S Province as an Example

主办侦查员制度改革是全面深化公安改革的重要内容之一。调研S省D县主办侦查员制度运行情况,发现该试点探索了较为有效的运行模式,也获得了一定的收获。但依然面临诸多困境,如:主办侦查员缺乏相应权力,相应责任及追责没有落实;主办侦查员的考核体系还不完善;激励不足且缺乏长效保障机制,等等。因此,除了借鉴试点的有效模式外,还应当完善法律、法规及其他相关制度,严格落实相关规定;完善考核体系,加强对主办侦查员的监督;落实长效的保障机制。

Chief investigator system is one of the important contents in comprehensively deepening reform of the public security system. The pilot reform in D county of S province has explored more operation mode according to the survey, while some difficulties should not be ignored, including lacking corresponding authority for chief investigator, failure to carry out corresponding responsibilities, imperfect assessment system, insufficient incentives and long-term protection mechanisms,etc.. In addition to learning from effective model of the pilot experience,Laws, regulations and other relevant systems should be improved, the assessment system should be perfected, and a long-term safeguard mechanism should be implemented.
