摘要
"福利为本"和"儿童利益最大化"作为少年司法的理念,在适用对象以及利益平衡等方面存在缺陷,也不符合青少年刑法的目的和司法实务的状况。现代少年司法的理念应当是矫正和分流。我国的少年司法制度应当在一些方面进行相应改革,以便充分贯彻矫正和分流的理念,有效实现预防犯罪和减少再犯。
The concepts of juvenile justice, welfare-oriented and maximizing the interests of children, lead to some defaults on applicable objects and interests balance. Meanwhile, they also aren’t in line with the aims of juvenile criminal law and the status of judicial practices. Therefore, the modern juvenile justice should emphasize rehabilitation and diversion. In order to fully implement rehabilitation and diversion, effectively actualize crime-prevention and reduce recidivism, the juvenile justice system should be reformed in some relevant aspects in China.
