对单价形式的清单计价合同“合同价款(格)约定问题”的探讨

Discussion on the Contract Pricing Issue in the Unit Price Contract with BOQ

现行GB 50500—2013《建设工程工程量清单计价规范》定义了"合同价款(格)",并且规定实行招标的建设工程"合同价款(格)"在施工合同中标通知书发出之日起30d内应予以约定。对此本文提出异议,认为"规范"中"合同价款(格)"的定义存在问题,并认为对于清单单价合同,其合同价款(格)的约定行为应发生在工程建设实施的过程中,而非工程实施之前,实施之前约定的只是合同双方认可的中标合同"金额",而非"价款(格)"。

The current "Code of Bills of Quantities and Evaluation for Construction Works"(GB 50500-2013) defines the term of"contract price", and stipulates that the price for the bidding works shall be agreed within 30 days from the day on which the letter of acceptance issued. To this, the article puts forward objection. This paper holds the view that the definition of the contract price in the code is not proper,and the price for unit price contract is an ongoing activity and cannot be reached on a point of time before the execution of the works. And what agreed before the execution of the works is an accepted contract amount but not a contract price.
