摘要
国际航运温室气体排放的法律属性决定着对其的规制方式以及法律适用,然而关于国际航运所产生的温室气体排放是否属于海洋污染的问题历来备受争议,并在学界以及实务界引发了激烈争论。为减少分歧,辨清国际航运温室气体排放的法律性质尤为重要。根据国际法对于海洋污染的界定,国际航运所产生的温室气体排放在理论上可以被认定为是一种"有条件的"海洋污染。这种理论主张为各国在国际航运温室气体排放的法律问题上采取不同的立法选择提供了极大的空间,且这一问题的讨论对于促进有关国际航运温室气体排放的国际谈判和调整意义重大。
The legal nature regarding greenhouse gas emission by international shipping is highly relevant to its governance and legal implementation. However,the issue has long been controversial thus attracted huge attention from academia and practitioners. In order to eliminate arguments,it is important to identify the legal nature of greenhouse gas emission via international shipping. According to the definition of marine pollution in International Law,the greenhouse gas emission generated by international shipping can theoretically be regarded as a kind of "conditional"marine pollution. This theory advocates that there is a great space for countries to adopt different legislative choices on the legal issue of international shipping greenhouse gas emission. And the discussion of this issue is of great significance for promoting relevant international negotiation and adjustment.
