进一步完善生态红线落地程序和方法

Procedures and Methods for Ecological Protection Red Line Delimitation Should be Further Strengthened

生态保护红线正在落地过程中,面临着已划定生态保护红线内已经合法存在的一些自然资源产权处理问题,特别是建设用地、基本农田以及矿业权如何退出问题。本文试图结合国外自然保护划定的情况,建议要在保护优先、节约优先的原则下,差别处理自然资源保护和开发的关系,按照生态红线的自然规律、经济规律和社会规律科学划定生态保护红线比例,进一步完善生态红线落地程序和方法,加强立法建设。

During the process of the implementation of ecological protection red line, there are some problems in legal property rights of natural resources disposition, especially the withdrawal of construction land, basic farmland and mining rights. Combining foreign conservation delimit, this paper tries to propose that assessment of ecological protection red line delimitation. Under the principle of protecting and saving preference, it should deal with the relationship between natural resource protection and development differently. According to the natural, economic, and social law of the ecological red line, it should define ecological protection line scale. Further, it should improve ecological red line landing procedures and methods, and strengthen the construction of legislation.
