探索宅基地“三权分置”的实现路径及现实困境

Exploration on the Implementation Path and Realistic Difficulties of the “Three Rights Division”

农村人口非农化和老龄化,导致大量"空心村"的出现,宅基地资源被严重浪费。部分试点地区实施了宅基地"三权分置"之后,大大地增加了农民的财产性收入,又激活了大量的农村宅基地市场,但是该政策在理论方面还很落后。本文主要运用文本分析法,从宅基地集体所有权、农户资格权、使用权入手,解读"三权分置"的权利结构和实现路径,最后提出改革中可能存在的一系列风险和规避措施。

The emergence of lots of"hollow villages"caused by the non-agriculturization and aging of the rural population cause waste of lots of rural residential land.For this,China has executed the"three rights division"of rural residential land in some areas,which can not only promote capital to the countryside but also can activate large-scale rural housing land market.However,the theory of this policy is poor,This paper,method used is text analysis,through the collective ownership,qualification right and the right to use,deciphers right structure of"three rights division"and its path.In the last,this text,analyzes the possible risks in the reform and proposes avoiding measurements.
