Research on the Standard Essential Patents Strategies Towards the New Generation of ICT Industrial Competition and China's Countermeasures

[目的/意义]新一代ICT及其标准化作为产业跨界融合的经济增长"引擎",成为了新一轮产业革命的主线,更是世界各国争相抢占的战略"高地"。随着5G、物联网等呼之欲出的大规模应用,巨大的市场体量必将催生新一轮标准必要专利大战。[方法/过程]在分析近年国际上出现的与标准必要专利相关的司法实践新规则、新战略,以及部分国家和地区针对标准必要专利许可实践所做的战略安排与政策指引的基础上,结合我国标准必要专利存量及诉讼现状,分别从国家、产业和企业三个层面提出战略应对。[结果/结论]从战略上来看,欧盟成为了"谈判、诉讼、禁令"三位一体的标准必要专利战略模式实施的主战场、禁诉令成为跨国平行诉讼的新型战略工具、急需面向新一代ICT的产业标准必要专利许可实践引导。由此,企业应做好标准必要专利诉讼的风险识别、应对和管理;产业应加强企业标准必要专利许可实践的引导服务;国家应构建禁令制度体系。

[Purpose/Significance ]The new generation of ICT and its standardization, as the "engine" of the economic growth for industrial convergence, have become the backbone of the fourth industrial revolution and the strategic “highland” that all of the industrial countries are vying for. With the coming large-scale applications of 5G and the Internet of things, the huge market volume is bound to bring a new wave of standard essential patent wars.[Method/Process ]Based on the analysis of the standard essential patents' new rules and strategies in the judicial practice from a global level, and the investigation of the strategical policy guides in EU and Japan, it gives some suggestions from three perspectives, taking Chinese companies' essential patent holding and related litigation into consideration.[Result/Conclusion ]From the strategic point of view, EU has become the promised battlefield for a trinity pattern of standard essential patents strategy, anti-suit injunction has been strategically used in those parallel international litigation, and it is necessary for the Chinese government and industrial service organizations to strengthen the negotiation guides for the standard essential patents licensing. Accordingly, local companies should strive to identify, respond and manage the risk of the standard essential patent lawsuits.
