软法视角下我国社区治理模式研究

Community Governance Model in China From the Soft Law Perspective

随着我国对基层社区治理的不断探索创新,社区治理的新模式正在逐步形成,软法在社区治理过程中所起到的作用日益增强。与硬法相比,软法更加重视与群众之间的民主协商和沟通对话,这在本质上是与创新型社区治理理念相一致的。但是,从我国目前社区治理过程中软法的运行情况来看,仍存在制度保障不足、群众支持不足等问题,需要通过分离政府控制权力、健全实施保障机制和协调社区治理主体地位等措施来改善。

With the development of China’s community construction,new model for community governance is forming in shape where soft law is playing more role in the process of management. Comparing with the hard law,soft law pays more attention to negotiation and communication,which agrees to the innovative community governance philosophy. However,the current situation reflects that there are still problems such as inadequate system guarantee and insufficient people’s support. This requires a separate governance power to take care of. Measurements such as completing guarantee system and adjusting the subject status.
