摘要
相较于仲裁而言,调解是一种低成本、高效率解决劳动争议的方法,不仅为劳动争议双方节约了大量的时间、金钱和精力,也节省了司法资源。仲裁调解作为劳动争议仲裁中的强制程序,在我国的劳动争议处理中发挥着重要的作用。本研究分析了可能影响该环节的关键因素,探讨了劳动争议案件特征、调解主体特征对劳动争议仲裁中调解结果的影响。随后,从北京市海淀区和昌平区两个劳动仲裁庭2007-2014年的裁决书和调解书中提取相关数据对理论模型进行实证检验。研究结果显示,在劳动争议案件特征维度中,案件诉求金额和劳动者委托律师代理会显著影响仲裁调解的结果;在调解主体特征维度中,企业所有制形式和仲裁员性别会显著影响仲裁调解的结果。
Compared with arbitration,mediation is a low-cost and efficient method to solve labor disputes,which not only saves a lot of time,money and energy for both parties involved in labor disputes,but also saves judicial resources.Mediation,as a compulsory procedure in labor disputes arbitration,plays an important role in China's labor disputes settlement mechanism.This study analyzes the key factors that may affect mediation outcome,and discusses the impact of(1)Disputes Characteristics,(2)Employee,Employer,and Mediator Characteristics,on the mediation results.This paper then tests this model by using data from a sample of awards rendered by Labor Arbitration Committees in Haidian District and Changping District of Beijing Municipality,China between 2007and 2014.The results indicate that(1)among the disputes characteristics dimensions,the amount of money in litigation and a lawyer chosen as a representative by the laborers would significantly affect mediation outcome;(2)among Employee,Employer,and Mediator Characteristics dimensions,mediator’s gender and forms of enterprises’s ownership would affect mediation outcome.
