摘要
法律保护是个人信息保护的重要组成部分。为推动个人信息保护法律体系的构建,加快《个人信息保护法》立法进程,通过文献分析和实证研究,系统梳理了个人信息保护的立法、司法、执法实践。认为我国的个人信息法律保护取得了显著成就,但同时也存在一些不容忽视的问题。一是法律规定分散、未能形成完整的个人信息保护法律体系,二是司法实践中刑法强、民法和行政法弱问题突出。应加快《个人信息保护法》立法进程,组建统一的行政执法队伍,创新个人信息保护司法机制,实现法律对个人信息的全面保护。
Legal protection is an important part of personal information protection. In order to promote the construction of legal system of personal information protection and speed up the legislative process of the law on the protection of personal information, this article systematically combs the legislative, judiciary and law-enforcing practices on personal information protection through documentary analysis and empirical studies. It argues that the legal protection of personal information in China has achieved remarkable accomplishments. However, some problems which cannot ignore still exist, namely scattered legal provisions, lack of complete legal system on personal information protection, the powerfulness of criminal laws and the weakness of civil and administrative laws in the judiciary practices. The government should accelerate the legislative process of the law on personal information protection, establish a unified team of law enforcement, and innovate the judiciary mechanism of personal information protection, so as to achieve the comprehensive legal protection of personal information.
