农地转非中土地增值收益产生环节及归属探析

An Analysis of the Production Process and Attribution of Land Value-added Income in Land Expropriation

农地转非中因土地用途改变而产生的巨大土地增值收益,学界对此收益归属有“涨价归公”、“涨价归农”以及“公私兼顾”三种理论之争。通过对土地增值收益产生环节及现实归属分析,认为应坚持公平分享土地增值收益下的“公私兼顾”理论,重构土地增值收益分配格局,让农民分享更多的增值收益。

In land expropriation,there is a huge land value-added income because of the change of land use.Three theories can be applied to explore the attribution of the land value-added income,including theory of increasing prices and returning to public ownership,theory of increasing price to farmers and theory of balance between public and private interests.Through the analysis of the production process of land value-added income,the author thinks that the theory of balance between public and private interests,in which the land value-added income is shared fairly,should be adopted,that the attributing pattern of the land value-added income should be reestablished,and that the distribution ratio of the farmers should be increased.
