Research on the Mechanism of Crowd-Sourced Online Dispute Resolution in Cross-Border Electronic Commerce

跨境电商降低了交易成本,使跨境小额电子商务交易成为可能。在"一带一路"等一系列政策的带动下,我国跨境电商发展步入"快车道",随之产生的跨境纠纷争议也在不断增加。跨境电商纠纷具有小额化、频次多发的特点,对于7×24小时不间断进行的跨境交易而言,如果不能快速、便捷地解决争议,势必影响公众对跨境电商的信心,制约其进一步发展。探索新型跨境电商争议解决机制,形成对现有机制的补充和改进,不仅是保障跨境电商持续发展的需要,也是我国深化多元化纠纷机制改革的需要。

Cross-border e-commerce has greatly reduced the transaction costs,which makes small cross-border e-commerce transactions possible.Driven by a series of policies such as "belt and road",China's cross-border e-commerce has begun a high-speed development stage.Consequently,disputes arising from cross-border e-commerce activities increase rapidly.Disputes arising from cross-border e-commerce activities are characterized by small amounts and frequent occurrences.For cross-border e-commercetransactions which last 24 hours a day and 7 days a week continuously,if the disputes can not be resolved quickly and directly,they will certainly affect the confidence of the public in cross-border e-commerce and restrict its further development.Therefore,exploring a new resolution mechanism for cross-border e-commerce disputes so as to form a complement and improvement of the existing mechanism is not only to meet the requirements for ensuring the sustainable development of cross-border e-commerce,but also to meet the requirements for deepeningChina's reform of diversified dispute mechanisms.
